Personal data being &#8220;<em>Any data relating to a natural person and likely to contribute to their identification, directly or indirectly, whether this data is confidential or public (&#8220;Personal Data&#8221;).<\/em>&#8221; <\/p><p>The purpose of this Charter is to set out the conditions under which collected personal data is processed and used, in order to best inform the individuals concerned. The Charter is an integral part of the general terms and conditions of the Mandate, with capitalized terms having the same definition as those in the Mandate. <\/p><p>PEF 2 attaches particular importance to the protection of its Principals&#8217; personal data.<\/p><ol><li><strong>IDENTITY OF THE DATA CONTROLLER<\/strong><\/li><\/ol><p>The company PEF 2, a simplified joint-stock company with a capital of 51,020 euros, having its registered office at 10, boulevard Malesherbes 75008 Paris, registered with the Paris Trade and Companies Register under number 881 211 569, represented by Mr. Christian NORMANN, President, duly authorized for the purposes hereof,<\/p><p>(Hereinafter, &#8220;<strong>PEF 2<\/strong>&#8220;)<\/p><p>Contact details of the Data Protection Officer (DPO):<\/p><p>Christian NORMANN<br>10, boulevard Malesherbes<br>75008 Paris<\/p><p><a href=\"mailto:cnormann@enerfin.eu.com\">cnormann@enerfin.eu.com<\/a><\/p><ol start=\"2\"><li><strong>COMPLIANCE WITH THE LAW OF JANUARY 6, 1978, KNOWN AS THE &#8220;DATA PROTECTION ACT&#8221; AND REGULATION 2016\/679<\/strong><\/li><\/ol><p>PEF 2 is responsible for the processing of personal data and undertakes to comply, on the one hand, with Law No. 78-17 of January 6, 1978, relating to data processing, files, and freedoms, known as the &#8220;Data Protection Act,&#8221; as amended by the law of August 6, 2004, and on the other hand, with European Regulation EU\/2016\/679.<\/p><ol start=\"3\"><li><strong>CONSENT<\/strong><\/li><\/ol><p>By signing the Mandate, the Principal accepts PEF 2&#8217;s privacy policy and consents to the collection of certain data according to the terms and principles described below.<\/p><p>The creation of an account in the Principal&#8217;s name (the &#8220;User Account&#8221;) with PEF 2 is impossible if the mandatory information requested in the registration form is missing.<\/p><ol start=\"4\"><li><strong>COLLECTION METHODS<\/strong><\/li><\/ol><p>PEF 2 may collect information concerning the Principal at different times.<\/p><ul><li>When entering personal information for the creation of a User Account;<\/li><li>During written or oral exchanges (emails, chat, etc.) with the Principal or with companies involved in the execution of the Mandate.<\/li><\/ul><p>The communication and processing of data are essential for the execution of the Mandate and the provision of services and\/or compliance with the legal and regulatory requirements to which the Mandate is subject. Outside of these cases, no data is collected without the Principal&#8217;s prior consent.  <\/p><ol start=\"5\"><li>COLLECTED INFORMATION<\/li><\/ol><p>The information collected for the creation of a User Account is as follows:<\/p><ul><li>Last name and first name;<\/li><li>Usual name,<\/li><li>Nationality,<\/li><li>Professional situation<\/li><li>Date and place of birth;<\/li><li>Email address;<\/li><li>Mailing address,<\/li><li>Place of tax residence,<\/li><li>Phone number,<\/li><li>Family situation,<\/li><li>All voluntarily provided information.<\/li><\/ul><p>In addition to the information collected, the execution of the Mandate requires the provision of additional documents, including:<\/p><ul><li>Two valid identity documents, including the national identity card,<\/li><li>Proof of address, dated less than 3 months ago,<\/li><li>A bank account statement,<\/li><li>Additional documents for certain cases<\/li><li>Compliant quote<\/li><li>Compliant invoice<\/li><li>CEE contribution framework<\/li><li>RGE<\/li><li>Photos of work completion report<\/li><li>Mandate<\/li><li>GDPR<\/li><li>Tax notice<\/li><li>Agreement notification<\/li><li>Payment letter<\/li><li>Advance premiums<\/li><li>Family record book<\/li><li>Proof of ownership<\/li><li>Request for additional information<\/li><li>Premium receipt notice<\/li><li>Audit summary<\/li><li>Audit Invoice<\/li><li>Work conformity certificate<\/li><li>Withdrawal notification<\/li><\/ul><p>Furthermore, data is collected during exchanges with the Principal or companies involved in the execution of the Mandate.<\/p><ol start=\"6\"><li><strong>PURPOSES<\/strong><\/li><\/ol><p>PEF 2 will only collect data that is adequate, relevant, and strictly necessary for the purpose of processing, in compliance with the principle of proportionality.<\/p><p>Depending on the situations, the purposes are as follows:<\/p><ul><li>Account data is used for:<ul><li>the creation of a file of registered Principals,<\/li><li>the management of each Principal&#8217;s User Account,<\/li><li>enabling the execution of the Mandate,<\/li><li>complying with legal and regulatory obligations,<\/li><li>fighting against fraud,<\/li><li>securing transactions,<\/li><li>establishing proof of services rendered related to the execution of the Mandate,<\/li><li>providing personalized offers<\/li><li>establishing official documents<\/li><\/ul><\/li><li>In case of subscription to the PEF 2 newsletter, the email address is used for sending our mailings related to PEF 2 news and for creating a file of users subscribed to the Newsletter;<\/li><\/ul><p>As technology evolves, PEF 2 may need to add purposes not yet provided for in this Charter. In such cases, changes to the privacy rules will be made on this page. <\/p><ol start=\"7\"><li>DATA RECIPIENTS<\/li><\/ol><p>The data and information collected on the Principal are intended for:<\/p><ul><li>certain PEF 2 employees, as well as its potential subcontractors or partners whose intervention is necessary for the execution of services, who are subject to the same rules on personal data protection as PEF 2,<\/li><li>public authorities when they request it, or within the framework of regulatory or legal obligations.<\/li><\/ul><p>No sale of this collected data will be made.<\/p><p>PEF 2 reserves the right to transfer personal data in the event of a change in its control or the sale of all or part of its assets, particularly through acquisition or merger with another company.<\/p><p>The personal data collected is not transferred outside the European Union.<\/p><p>Nevertheless, data may be transmitted to competent authorities upon request, particularly to public bodies, exclusively to meet legal obligations, judicial auxiliaries, ministerial officers, and organizations responsible for debt collection.<\/p><ol start=\"8\"><li>RETENTION PERIOD<\/li><\/ol><p>Data is retained by PEF 2 for the period necessary for the purposes for which it was collected and to meet legal and\/or regulatory obligations. It is specified in particular that: <\/p><ul><li>for personal account management, data is retained as long as the User Account is active, and for 5 years after the creation of the User Account;<\/li><li>for managing the Site&#8217;s newsletter subscription, the email is retained as long as the Principal does not express a desire to unsubscribe and for 5 years from the last visit to the Site via links in the newsletters;<\/li><\/ul><p>However, certain data may be retained and anonymized for statistical purposes.<\/p><ol start=\"9\"><li>PRINCIPAL&#8217;S RIGHTS<\/li><\/ol><p>The Principal has several rights to assert at the address indicated in Article 2 hereof, including:<\/p><ul><li>right to access their data undergoing processing (Article 15 of the GDPR),<\/li><li>right to withdraw their consent at any time, without affecting the processing carried out until then and provided that the withdrawal of consent does not contravene the ongoing use of the Services (Article 7 of the GDPR),<\/li><li>right to obtain the rectification of inaccurate data or the completion of incomplete data (Article 16 of the GDPR),<\/li><li>right to obtain the erasure of their data, in the cases provided for in Article 17 of the GDPR after account deletion,<\/li><li>right to data portability (Article 20 of the GDPR),<\/li><\/ul><p>Under this right to personal data portability, the Principal may also request that the data be transmitted directly to another data controller, provided that this is technically possible.<br>It is nevertheless specified that this right to portability does not cover statistical or anonymized data, nor inferred and derived data created by PEF 2 from the data provided.<\/p><ul><li>right to lodge a complaint with the CNIL (Article 13 of the GDPR).<\/li><\/ul><p>Any request must be accompanied by a photocopy of a compliant and valid identity document and will be processed within a maximum of 2 months of receipt.<\/p><p>Finally, the Principal may define directives concerning the retention, erasure, and communication of their personal data after their death.<\/p><ol start=\"10\"><li>TELEPHONE SOLICITATION<\/li><\/ol><p>BLOCTEL is the telephone solicitation opt-out list on which any consumer can register for free in order not to be telephoned by a professional with whom they do not have an ongoing contractual relationship, in accordance with Law No. 2014-344 of March 17, 2014, relating to consumption.<\/p><p>The law specifies that it is prohibited for any professional, directly or through a third party acting on their behalf, to telephone a consumer registered on this list, with the exception of cases enumerated by law.<\/p><p>In particular, the Principal may still be called in the following cases:<\/p><ul><li>By professionals with whom the Principal has an ongoing contract;<\/li><li>For prospecting calls for the supply of newspapers, periodicals, or magazines;<\/li><li>For reasons not related to the sale of goods or services such as:<ul><li>Calls from a public service;<\/li><li>Calls from research and polling institutes;<\/li><li>Calls from non-profit organizations;<\/li><\/ul><\/li><li>If the Principal has freely and unequivocally provided their number to be called back.<\/li><\/ul><p>If the Principal is registered on BLOCTEL, PEF 2 will be authorized to call the Principal solely for the purpose of executing the Mandate.<\/p><p>For more information, you can consult the website <a href=\"https:\/\/conso.bloctel.fr\/\">https:\/\/conso.bloctel.fr\/<\/a>.<\/p><ol start=\"11\"><li>SECURITY<\/li><\/ol><p>PEF 2 undertakes to make its best efforts to protect your personal data, in particular to prevent it from being distorted, damaged, or communicated to unauthorized third parties.<\/p><ol start=\"14\"><li>COMPLAINTS and APPLICABLE LAW<\/li><\/ol><p>In case of a complaint, the Principal may lodge a complaint with the National Commission for Data Protection (CNIL):<\/p><p>Commission Nationale de l\u2019Informatique et des Libert\u00e9s<br>3 Place de Fontenoy<br>TSA 80715 \u2013 75334 PARIS CEDEX 07<br>Tel: 01 53 73 22 22<br>Fax: 01 53 73 22 00<br><a href=\"https:\/\/www.cnil.fr\/fr\/vous-souhaitez-contacter-la-cnil\">https:\/\/www.cnil.fr\/fr\/vous-souhaitez-contacter-la-cnil<\/a><\/p><p>Any dispute relating to the use of your personal data is subject to French law.<\/p><p>Any claim or dispute arising from the interpretation or execution of these personal data preservation provisions will be submitted to the competent courts under ordinary law conditions.<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t\t<\/div>\n\t\t<\/div>\n\t\t\t\t\t<\/div>\n\t\t<\/section>\n\t\t\t\t<\/div>\n\t\t","protected":false},"excerpt":{"rendered":"<p>Data Protection This Personal Data Charter (the &#8220;Charter&#8220;) is current as of October 15, 2021.
